February 8, 2011

CALL TO ORDER

A Regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman Frank D. Formica at 4 p.m., Eastern Standard Time, on the above-mentioned date at the Stillwater Building, 201 Shore Road, Northfield, New Jersey.

OPEN PUBLIC MEETING
STATEMENT

Statement of Open Public Meeting Compliance:  Pursuant to the Open Public Meetings Act, Chairman Formica announced that adequate notice of this meeting, as required by said Act, has been provided to The Press, the Mainland Journal, posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk’s Office in Mays Landing.

PRAYER AND FLAG SALUTE

The prayer was led by Freeholder Cooper followed by the flag salute led by Chairman Formica.

The following roll call was recorded:  PRESENT: Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  ABSENT:  None.

MINUTES OF MEETING
JANUARY 25, 2011

Freeholder Sutton moved and Freeholder Schroeder seconded a motion to adopt and dispense with the reading of the January 25, 2011 minutes.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

PRESENTATION

Proposed Plasma Gasification Project at the Atlantic County Utilities Authority (ACUA) presented by NRG.

ORDINANCE NO. 3 - 2011
FINAL READING
AMENDING CHAPTER NINETY-SEVEN, PARKS, ARTICLE XII, GOLF OF THE ATLANTIC COUNTY CODE

Freeholder Sutton moved and Freeholder Cooper seconded a motion to adopt on final reading Ordinance No. 3-2011, an Ordinance to amend Chapter Ninety-seven, Parks, Article XII, Golf of the Atlantic County Code.

Chairman Formica opened the meeting to the public for their comments on Ordinance No. 3 - 2011 at 4:45 p.m.  Being none, Chairman Formica closed the public portion at 4:45 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 60
AMENDING RESOLUTION NO. 649 (12/7/10) REGARDING A PROFESSIONAL SERVICES AGREEMENT FOR FORENSIC PATHOLOGIST SERVICES

Freeholder Cooper moved and Freeholder Giordano seconded a motion to amend Resolution No. 649 adopted on December 7, 2010 and authorizing the County Executive to enter into professional services contracts with various pathologists for forensic pathologist services to add Eric Duval, D.O. at no additional cost beyond the aggregate amount not to exceed $40,000.00 for all forensic pathologists authorized by Resolution No. 649.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 61
BID CONTRACTS FOR PREVENTATIVE MAINTENANCE FOR ATLANTIC COUNTY VEHICLES

Freeholder Dase moved and Freeholder Sutton seconded a motion to award bid contracts to Ed and Gene’s King Tire, LLC and Guenther’s Mobile Service to provide preventative maintenance for Atlantic County Vehicles for amounts not to exceed $22,000.00 and $8,000.00, respectively.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 62
BID CONTRACT FOR MEDICAL TRANSPORTATION FOR MEADOWVIEW NURSING HOME

Freeholder Sutton moved and Freeholder Bertino seconded a motion to award a bid contract to Mercylife Ambulance, Inc. for medical transportation for Meadowview Nursing Home for an amount not to exceed $20,000.00.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None.

RESOLUTION NO. 63
GRANT APPLICATION FOR THE REHABILITATION OF COTTON MILL BRIDGE IN HAMILTON TOWNSHIP

Freeholder Giordano moved and Freeholder Bertino seconded a motion to submit a grant application and execute a grant agreement with the New Jersey Department of Transportation for the 2011 Local Bridges Future Needs Project for the rehabilitation of Cotton Mill Bridge in Hamilton Township for funding in the amount of $1,000,000.00.

RESOLUTION NO. 64
GRANT APPLICATION FOR THE ENERGY EFFICIENCY AND CONSERVATION BLOCK GRANT REBATE PROGRAM

Freeholder Schroeder moved and Freeholder Cooper seconded a motion to submit a grant application to the New Jersey Board of Public Utilities Clean Energy Program for the Energy Efficiency and Conservation Block Grant Rebate Program for Phase II for funding in an amount not to exceed $50,000.00.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 65
APPOINTMENTS TO THE ATLANTIC COUNTY POLICE TRAINING ADVISORY BOARD

Freeholder Dase moved and Freeholder Schroeder seconded a motion to appoint Chief Joseph Cowan and Chief Patrick Moran to the Atlantic County Police Training Advisory Board for terms to expire on May 1, 2014.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 66
APPOINTMENT TO THE ATLANTIC COUNTY POLICE TRAINING ADVISORY BOARD

Freeholder Giordano moved and Freeholder Sutton seconded a motion to appoint Chief Darren Dooley to the Atlantic County Police Training Advisory Board for an unexpired term to expire on May 1, 2012.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 67
REAPPOINTMENTS TO THE ATLANTIC COUNTY CONSTRUCTION BOARD OF APPEALS

Freeholder Formica moved and Freeholder Schroeder seconded a motion to reappoint Robert Lemon and Clement F. Wasleski to the Atlantic County Construction Board of Appeals for terms to expire on January 1, 2015.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 68
REAPPOINTMENT OF A SPECIAL MEMBER TO THE ATLANTIC COUNTY CONSTRUCTION BOARD OF APPEALS

Freeholder Garrett moved and Freeholder Dase seconded motion to reappoint Kevin Dixon as special member to the Atlantic County Construction Board of Appeals for a term to expire on January 1, 2015.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 69
URGING PASSAGE OF LEGISLATION REGARDING “AMERICAN HEROES DAY”

MOTION

Freeholder Giordano moved and Freeholder Sutton seconded a motion to adopt a resolution urging passage by the New Jersey Legislature of Senate Joint Resolution No. 35 (213th Legislature) and Assembly Joint Resolution No. 28 (214th Legislature), “American Heroes Day,” when reintroduced (Sponsor:  Freeholder Cooper).

Freeholder Cooper moved and Freeholder Schroeder seconded a motion to suspend the rules and permit the public to speak regarding Resolution No. 69.

The above-mentioned motion was adopted by the following roll call:  AYES:  Bertino, Cooper, Dase, Garrett, Giordano, McDevitt, Schroeder, Sutton and Formica.  NAYS:  None.  ABSTENTIONS:  None. 

Chairman Formica opened the meeting to the public for their input on Resolution No. 69.

James Smith, Absecon Firefighter, thanked the Board for supporting this resolution.

There were no further comments, and Freeholder Formica closed the public portion.

REPORTS OF SPECIAL COMMITTEES OF THE BOARD

Freeholder McDevitt reported he met with the Freeholders regarding the 2011 Budget.

Freeholder Sutton reported that the Roads and Bridges Committee met today.

There was no unfinished business.

NEW BUSINESS

There was no new business.

WRITTEN COMMUNICATIONS AND PETITIONS

There was no written communications for the period of February 2, 2011 to February 8, 2011.

 

PUBLIC COMMENTS

Chairman Formica opened the meeting to the public at 5:02 p.m.  There were no public comments.  Chairman Formica closed the public portion at 5:03 p.m.

GOOD OF THE ORDER

Freeholder Schroeder expressed he would like to retain the Atlantic County Kids Count Committee.

Freeholder Garrett stated that the rating comes every three years for Kids Count.

ADJOURNMENT

Chairman Formica entertained a motion to adjourn the Freeholder meeting.  Freeholder Schroeder moved and Freeholder Sutton seconded a motion to adjourn the Freeholder meeting.  The motion was unanimously passed.  The meeting was adjourned at 5:15 p.m.
