April 20, 2010

CALL TO ORDER

A Regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman James Curcio at 4:00 p.m., Eastern Daylight Savings Time, on the above-mentioned date at the Auditorium, Atlantic County Office Building, 1333 Atlantic Avenue, Atlantic City, New Jersey.

OPEN PUBLIC MEETING STATEMENT

Statement of Open Public Meeting Compliance:  Pursuant to the Open Public Meetings Act, Chairman Curcio announced that adequate notice of this meeting, as required by said Act, has been provided to The Press, the Mainland Journal, posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk’s Office in Mays Landing.

PRAYER AND FLAG SALUTE

The prayer was led by Freeholder Cooper followed by the flag salute led by Chairman Curcio.  God Bless America sung by Pat Maschetta.

The following roll call was recorded:  PRESENT: Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio. ABSENT:  None.

MINUTES OF MEETING
MARCH  23, 2010

Freeholder Cooper moved and Freeholder Sutton seconded a motion to adopt and dispense with the reading of the March 23, 2010 minutes.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None. 

PROCLAMATION

Freeholder Frank V. Giordano and Freeholder Charles T. Garrett presented a proclamation to Matthew Pinto congratulating and thanking him for his service in Afghanistan.

ORDINANCE NO. 7A-2010
AMENDMENTS
TO ORDINANCE NO. 7A REGARDING SOLID WASTE FLOW CONTROL

Freeholder Schroeder moved and Freeholder Formica seconded a motion to adopt the amendments to Ordinance No. 7A of 2010 regarding Solid Waste Flow Control.

Chairman Curcio opened the meeting to the public for their comments on the amendments to Ordinance 7A of 2010 at 4:15 p.m.

Jack Cougler of the Salem County Improvement Authority, 19 Bore Avenue, Woodstown, New Jersey stated that the revenue amount is not correct.  He reported that the private haulers will not take trash to the ACUA at $68.00 a ton when a lesser charge, almost half the amount, is charged at other facilities.

There were no further comments, and the public portion was closed at 4:27 p.m.

ORDINANCE NO. 7A-2010
FINAL READING (AS AMENDED) REGARDING SOLID WASTE FLOW CONTROL

 

FREEHOLDER COMMENTS

Freeholder McDevitt moved and Freeholder Garrett seconded a motion to adopt on final reading Ordinance No. 7A of 2010 (As amended) amending the Atlantic County Solid Waste Management Plan to authorize Solid Waste Flow Control.

Chairman Curcio opened the meeting to the public for their comments on Ordinance 7A as amended at 4:29 p.m.  Being none, Chairman Curcio closed the public portion at 4:29 p.m.
Freeholder Cooper spoke in favor of the Solid Waste Ordinance.

Freeholder Sutton explained spoke in favor of the Solid Waste Ordinance.

Freeholder Schroeder stated that initially he had concerns regarding the municipal contracts and establishing a sunset provision.  With that, he is in favor.

Freeholder Dase also had concerns and thanked Freeholder McDevitt as the Chair of the Solid Waste Oversight Committee.

Freeholder McDevitt thanked the Board and the ACUA for an excellent job.

Chairman Curcio stated that no one’s rate should increase as a result of this ordinance.

RESOLUTION NO. 185A
FIRST READING
OPEN SPACE TAX RATE

Freeholder Sutton moved and Freeholder Cooper seconded a motion to introduce on first reading the County Open Space Preservation Trust Fund Tax Rate for 2010 at a rate of one half cent per $100.00 of valuation.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 186
AMENDING RESOLUTION NO. 590 (10/20/09) REGARDING A CONTRACT FOR A COLLEGE PREP PROGRAM FOR THE SUMMER YOUTH PROGRAM PARTICIPANTS

Freeholder Giordano moved and Freeholder Formica seconded a motion to amend Resolution No. 590 adopted on October 20, 2009 regarding a contract with Atlantic Cape Community College for a College Prep Program for the Summer Youth Program participants extending the contract term until March 31, 2010 at no additional cost.

RESOLUTION NO. 187
AMENDING RESOLUTION NO. 269 (5/13/08) REGARDING MAINTENANCE AND MONITORING OF THE FIRE AND SECURITY ALARM SYSTEMS AT VARIOUS COUNTY BUILDINGS

Freeholder Formica moved and Freeholder Giordano seconded a motion to amend Resolution No. 269 adopted on May 13, 2008 regarding an agreement with Atlantic Coast Alarm to provide maintenance and monitoring of the fire and security alarm systems at various county buildings for additional fire and security alarm services for the extended period from July 31, 2008 to June 30, 2010 at no additional cost.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 188
ACCESS AND USE OF THE NEW JERSEY ENVIRONMENTAL MANAGEMENT SYSTEM

Freeholder Sutton moved and Freeholder Formica seconded a motion to enter into an agreement with the New Jersey Department of Environmental Protection governing access and use of the New Jersey Environmental Management System by the Atlantic County Division of Public Health at no cost to the County.

RESOLUTION NO. 189
SUPPLEMENTAL CONTRACT FOR CERTAIN JANITORIAL AND PHOTOGRAPHIC SUPPLIES

Freeholder Sutton moved and Freeholder Formica seconded a motion to award a supplemental contract to Interline Brands d/b/a/ Amsan for the additional sum not to exceed $20,137.00, for a total amount of $31,830.45 for the vendor and a total amount for all vendors not to exceed $344,236.41.

RESOLUTION NO. 190
BID CONTRACT FOR LINEN REQUIREMENTS FOR THE MEADOWVIEW NURSING HOME

Freeholder Formica moved and Freeholder Giordano seconded a motion to award a bid contract to ATD American Company for linen requirements for the Meadowview Nursing Home for an amount not to exceed $31,190.14.

RESOLUTION NO. 191
CHANGE ORDER NO. 1 AND FINAL FOR                                                                                          DELILAH ROAD SECTION 5 RESURFACING

Freeholder Sutton moved and Freeholder Cooper seconded a motion to award change order No. 1 and final to contract with Richard Pierson Construction for a net reduction of $163,342.54 and for an adjusted contract amount not to exceed $479,546.46.

RESOLUTION NO. 192
CHANGE ORDER NO. 1 FOR CONTRACTS FOR VARIOUS VENDORS FOR MEDICAL REQUIREMENTS

Freeholder Schroeder moved and Freeholder Formica seconded a motion to award change order No. 1 for contracts for various vendors for medical requirements extending the contract term from February 1, 2010 to March 31, 2011 at no additional cost.

RESOLUTION NO. 193
AUTHORIZING THE COUNTY PROSECUTOR TO PURCHASE WITHOUT COMPETITIVE BIDDING SPECIAL EQUIPMENT FOR USE IN CONFIDENTIAL AND UNDERCOVER INVESTIGATIONS

Freeholder Formica moved and Freeholder Sutton seconded a motion to authorize the Atlantic County Prosecutor to purchase without competitive bidding to Enforcement Technologies Group, special equipment for use in confidential and undercover investigations for an amount not to exceed $28,199.99.

RESOLUTION NO. 200
REAPPOINTMENTS TO THE SENIOR CITIZEN ADVISORY BOARD

Reappointment of Howard Berger, Ann DeLaurentis and Phyllis Phelps to the Atlantic County Senior Citizen Advisory Board for terms to expire on January 31, 2013.

 

RESOLUTION NO. 201
REAPPOINTMENTS TO THE ATLANTIC COUNTY ADVISORY COMMISSION ON WOMEN

Reappointment of Robin Boniewicz, Janet D. Garraty, Phyllis M. Perkins, M.D., and Andrea Lee Ples to the Atlantic County Advisory Commission on Women for terms to expire on February 28, 2013.

 

PUBLIC PORTION

Chairman Curcio opened the meeting to the public for comments at 4:51 p.m.

Robert McNaulty (103 Florida Avenue, Egg Harbor Township) spoke regarding The Homes for Heroes Act (document enclosed).

There were no further public comments; Chairman Curcio closed the public portion at 5:02 p.m.

FREEHOLDER COMMENTS

Freeholder Giordano spoke regarding Matthew Pinto and his accomplishments.

Freeholder Sutton spoke regarding flooding in resident basements as a result of the rain.  Freeholder Sutton announced the FEMA number.

WRITTEN CORRESPONDENCE

Written correspondence was received by this office for the period of April 14, 2010 to April 20, 2010.

ADJOURNMENT

Chairman Curcio requested a motion to adjourn the Freeholder meeting.  Freeholder Garrett moved and Freeholder Cooper seconded a motion to adjourn the Freeholder meeting.  The motion was unanimously passed.  The meeting was adjourned at 5:08 p.m.
