April 13, 2010

CALL TO ORDER

A Regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman James Curcio at 4:00 p.m., Eastern Daylight Savings Time, on the above-mentioned date at the Stillwater Building, 201 Shore Road, Northfield, New Jersey.

OPEN PUBLIC MEETING STATEMENT

Statement of Open Public Meeting Compliance:  Pursuant to the Open Public Meetings Act, Chairman Curcio announced that adequate notice of this meeting, as required by said Act, has been provided to The Press, the Mainland Journal, posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk’s Office in Mays Landing.

PRAYER AND FLAG SALUTE

The prayer was led by Freeholder Garrett followed by the flag salute led by Chairman Curcio.

The following roll call was recorded:  PRESENT: Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio. ABSENT:  None.

MINUTES OF MEETING
MARCH  16, 2010

Freeholder Sutton moved and Freeholder Cooper seconded a motion to adopt and dispense with the reading of the March 16, 2010 minutes.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None. 

ATLANTIC COUNTY SHERIFF’S OFFICE PROMOTIONS AND SWEARING-IN OF NEW OFFICERS

Sheriff Frank Balles promoted Sheriff Officer Sgt. Sharon Jenni to Lieutenant and Officer Bruce M. Guthrie to Sergeant.

Sheriff Balles swore in the following new Sheriff Officers:  Lynne A. Deleon, Jeffrey M. Takotey, Antonio Colon III, Kenneth D. Emmons, Jr., Eric J. Price, Michael P. Cassady, Jr. and Matthew M. Ordille.

ORDINANCE NO. 8-2010
FIRST READING
PROHIBITING PARKING ON A PART OF OLD NEW YORK ROAD IN GALLOWAY TOWNSHIP

Freeholder Schroeder moved and Freeholder Dase seconded a motion to introduce on first reading Ordinance No. 8 of 2010 prohibiting parking on a part of Old New York Road (County Route 610) in the Township of Galloway.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

2010 COUNTY BUDGET

Freeholder Sutton moved and Freeholder Cooper seconded a motion to adopt the 2010 County Budget on final reading.

Chairman Curcio opened the meeting to the public for their comments on the 2010 County Budget at 4:31 p.m.  Being None, Chairman Curcio closed the public portion at 4:31 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, Schroeder, Sutton and Curcio.  NAYS:  McDevitt.  ABSTENTIONS:  None.

 2010 PUBLIC HEALTH BUDGET

Freeholder Giordano moved and Freeholder Cooper seconded a motion to adopt on final reading the Atlantic County Public Health Agency Budget Notice for 2010.

Chairman Curcio opened the meeting to the public for their comments on the 2010 Atlantic County Public Health Agency Budget at 4:48 p.m.  Being none, Chairman Curcio closed the public portion at 4:48 p.m.

2010 LIBRARY BUDGET

Freeholder Sutton moved and Freeholder Cooper seconded a motion to adopt on final reading the 2010 Annual County Library Budget.

Chairman Curcio opened the meeting to the public for their comments on the 2010 Atlantic County Library Budget at 4:49 p.m.  Being none, Chairman Curcio closed the public portion at 4:49 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

FINAL READING
EXCEEDING THE COUNTY BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A 2010 CAP BANK

Freeholder Sutton moved and Freeholder Giordano seconded a motion to adopt on final reading a Resolution to exceed the County Budget appropriation limits and to establish a 2010 cap bank (N.J.S.A. 40A:4-45.14).

Chairman Curcio opened the meeting to the public for their comments on Resolution No. 123 at 4:50 p.m.  Being none, Chairman Curcio closed the public portion at 4:50 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None. 

County Executive Dennis Levinson stated that preparing the 2010 budget took weeks and months of hard work. The County receives $1.7 million in funding for the State Inmates in the County Jail.  County Executive Levinson asked the Board to support the State taking their inmates out of the County Jail.  The County will lose $1.7 million in funding.

RESOLUTION NO. 175
JURISDICTIONAL AGREEMENT TO APPORTION THE JURISDICTION FOR HIGHWAY MAINTENANCE AND CONTROL AT THE INTERSECTION OF ROUTE 40 AND COLOGNE AVENUE IN HAMILTON TOWNSHIP

Freeholder Giordano moved and Freeholder Formica seconded a motion to enter into a jurisdictional agreement with the State of New Jersey, acting through its Commissioner for Transportation, to apportion the jurisdiction for highway maintenance and control at the Intersection of Route 40 and Cologne Avenue (CR No. 614) in Hamilton Township.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None. 

RESOLUTION NO. 176
PROFESSIONAL SERVICES CONTRACT FOR A PHYSICIAN TO PROVIDE SERVICES AS MEDICAL DIRECTOR

 

Freeholder Formica moved and Freeholder Sutton seconded a motion to award a professional services contract to Dr. Austin Gerber to provide services as Medical Director for Meadowview Nursing Home, the Division of Public Health and the Department of Public Safety for an amount not to exceed $36,225.00.

RESOLUTION NO. 177
INTERGOVERNMENTAL SERVICES AGREEMENT CONCERNING DEVELOPMENT OF AN AVIATION RESEARCH AND TECHNOLOGY PARK

Freeholder Sutton moved and Freeholder Formica seconded a motion to award an intergovernmental services agreement to the South Jersey Economic Development District for architectural design work for the Next Generation Aviation Research & Technology Park with the County providing HUD funds in an amount not to exceed $142,500.00.

RESOLUTION NO. 178
INTERGOVERNMENTAL AGREEMENT FOR TRAFFIC SIGNAL REPAIR

Freeholder Formica moved and Freeholder Sutton seconded a motion to award an intergovernmental services agreement to the Borough of Longport for traffic signal repair (revenue generating).

RESOLUTION NO. 179
AGREEMENT  FOR LICENSING AND SUPPORT FOR THE SEQUOIA TEAMWORK AND WINEDS VOTING SYSTEM

Freeholder Formica moved and Freeholder Sutton seconded a motion to enter into an agreement with Sequoia Voting Systems for software licensing and support for the Sequoia Teamwork and WINEDS Voting System for an amount not to exceed $99,858.00.

RESOLUTION NO. 180
BID CONTRACT FOR WINDOW CLEANING AT VARIOUS COUNTY LOCATIONS

Freeholder Formica moved and Freeholder Giordano seconded a motion to award a bid contract to Action Janitorial, Inc. for window cleaning at various County locations for an amount not to exceed $28,912.99.

RESOLUTION NO. 181
BID CONTRACT FOR PRISONER TRANSPORTATION SERVICES

Freeholder Formica moved and Freeholder Sutton seconded a motion to award a bid contract to North Atlantic Extradition Services for prisoner transportation services for Atlantic County for an amount not to exceed $23,000.00.

RESOLUTION NO. 182
BID CONTRACT FOR MOSQUITO SURVEILLANCE

Freeholder Formica moved and Freeholder Sutton seconded a motion to award a bid contract to Horizon Helicopters, Inc. for mosquito surveillance for an amount not to exceed $186,480.00.

RESOLUTION NO. 183
LEASES FOR NUTRITION SITES

Freeholder Formica moved and Freeholder Cooper seconded a motion to award leases with various nutrition sites throughout Atlantic County for an amount not to exceed $6,975.00.

RESOLUTION NO. 184
APPOINTMENT TO THE ATLANTIC COUNTY PARKS AND ENVIRONMENT ADVISORY COMMISSION

Freeholder Giordano moved and Freeholder Cooper seconded a motion to appoint Paul E. Galletta to the Atlantic County Parks and Environment Advisory Commission for a term to expire on July 1, 2012.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

Freeholder Formica moved and Freeholder Schroeder seconded a motion to add Resolution No. 185 to the agenda of the April 13, 2010 Freeholder meeting.

RESOLUTION NO. 185
URGING SIGNING OF NJ SENATE BILL NO. 920 BY GOVERNOR CHRISTIE

Freeholder Formica moved and Freeholder Giordano seconded a motion to adopt a Resolution urging the signing of NJ Senate Bill No. 920 by Governor Christie (Sponsor:  Freeholder Frank D. Formica).

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

Chairman Curcio opened the meeting for public comment at 5:27 p.m.  Being none, Chairman Curcio closed the public portion at 5:27 p.m.

FREEHOLDER COMMENTS

Freeholder Cooper announced that she attended the opening of the new fitness center at the Atlantic Cape Community College.

WRITTEN CORRESPONDENCE

There was written correspondence received by this office for the period of March 31, 2010 to April 13, 2010.

ADJOURNMENT

 Chairman Curcio asked for a motion to adjourn the Freeholder meeting.  Freeholder Cooper moved and Freeholder Sutton seconded a motion to adjourn the Freeholder meeting.  The motion was unanimously passed.  The meeting was adjourned at 5:29 p.m.
