CALL TO ORDER

A Regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman James Curcio at 4 p.m., Eastern Standard Time, on the above-mentioned date at the Stillwater Building, 201 Shore Road, Northfield, New Jersey.

OPEN PUBLIC MEETING STATEMENT

Statement of Open Public Meeting Compliance:  Pursuant to the Open Public Meetings Act, Chairman Curcio announced that adequate notice of this meeting, as required by said Act, has been provided to The Press, the Mainland Journal, posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk’s Office in Mays Landing.

PRAYER AND FLAG SALUTE

The prayer was led by Freeholder Dase followed by the flag salute led by Chairman Curcio.

FEBRUARY 9, 2010

Freeholder Cooper moved and Freeholder Giordano seconded a motion to adopt and dispense with the reading of the February 9, 2010 minutes.

Freeholder Sutton moved and Freeholder Giordano seconded a motion to introduce on first reading the 2010 County Budget.

Freeholder Cooper moved and Freeholder Sutton seconded a motion to introduce on first reading the Atlantic County Public Health Agency 2010 Budget Notice.

Freeholder Sutton moved and Freeholder Formica seconded a motion to introduce on first reading the 2010 Annual County Library Budget.

ORDINANCE TO EXCEED THE COUNTY BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A 2010 CAP BANK

Freeholder Sutton moved and Freeholder Formica seconded a motion to introduce on first reading an ordinance to exceed the County Budget appropriation limits and to establish a 2010 Cap Bank.

RESOLUTION NO. 124
AGREEMENT WITH THE BUENA REGIONAL SCHOOL DISTRICT FOR COMMUNITY LIBRARY SERVICES

Freeholder Sutton moved and Freeholder Formica seconded a motion to enter into an agreement with the Buena Regional School District for Community Library services for an amount not to exceed $7,000.00.

RESOLUTION NO. 125
AGREEMENT WITH ROYAL PRINTING SERVICES FOR ELECTION PRINTING SERVICES

Freeholder Sutton moved and Freeholder Giordano seconded a motion to enter into an agreement with Royal Printing Service for election printing services for the school, primary and general elections and any special elections held in 2010 for an amount not to exceed $82,675.50 (County’s Portion).

RESOLUTION NO. 126
INTER-GOVERNMENTAL SERVICES AGREEMENT FOR SUMMER CONCERTS

Freeholder Formica moved and Freeholder Sutton seconded a motion to enter into an inter-governmental services agreement with the Borough of Buena for the 2010 Summer Concert Series for an amount not to exceed $2,000.00.

RESOLUTION NO. 127
AGREEMENT FOR THE R.S.V.P. PROGRAM AND THE FOSTER GRANDPARENTS PROGRAM

Freeholder Sutton moved and Freeholder Cooper seconded a motion to enter into an agreement with Atlantic Human Resources for the Foster Grandparents Program ($6,559.38) and for the Retired Senior Volunteer Program ($10,642.02) for a total contract amount not to exceed $17,201.40.

RESOLUTION NO. 128
AMENDING RESOLUTION NO. 269 (5/19/09) REGARDING AN AGREEMENT FOR A TEEN PREGNANCY PREVENTION PROGRAM

Freeholder Giordano moved and Freeholder Cooper seconded a motion to amend Resolution No. 269 adopted on May 19, 2009 regarding an agreement with the Inwood House for a Teen Pregnancy Prevention Program for an additional amount not to exceed $29,400.00 and for a total amendatory contract amount not to exceed $147,717.00.

RESOLUTION NO. 129
PROFESSIONAL SERVICES CONTRACT FOR A SENIOR CITIZENS MEDICAL CLINIC

Freeholder Giordano moved and Freeholder Formica seconded a motion to award a professional services contract to Beron Jewish Older Adult Services of Atlantic County to provide nursing services for a Senior Citizens Medical Clinic for an amount not to exceed $36,000.00.

RESOLUTION NO. 130
SUB-GRANT AGREEMENTS FOR AREA PLAN GRANT PROGRAM SERVICES

Freeholder Giordano moved and Freeholder Dase seconded a motion to award sub-grant agreements with various organizations to Area Plan Grant Program Services for a total amount for all contracts not to exceed $612,345.00.

RESOLUTION NO. 131
CONTRACTS FOR AUTO BODY AND FENDER REPAIRS

Freeholder Dase moved and Freeholder Giordano seconded a motion to award contracts to Purdy Collision ($35,000.00) and G.J. Auto Repair and Service ($10,000.00) for auto body and fender repairs for an amount not to exceed $45,000.00 for both contracts.

RESOLUTION NO. 132
RENEWAL BID CONTRACT FOR OVERALL REFINISHING OF COUNTY VEHICLES

Freeholder Sutton moved and Freeholder Formica seconded a motion to enter into an agreement with Reli of Atlantic County, D.B.A. MAACO Collision Repair and Auto Painting for overall refinishing of County vehicles for an amount not to exceed $14,000.00.

RESOLUTION NO. 133
AMENDING RESOLUTION NO. 517 (9/22/09) REGARDING A CONTRACT FOR A SUPPLEMENTAL LEARNING LAB PROGRAM

Freeholder Schroeder moved and Freeholder Formica seconded a motion to amend Resolution No. 517 adopted on September 22, 2009 regarding a contract with Atlantic Cape Community College for a Supplemental Learning Lab Program for an additional amount not to exceed $45,000.00 and for a total amendatory contract amount not to exceed $121,973.00 for the extended term ending June 30, 2010.

RESOLUTION NO. 134
GRANT ACCEPTANCE FOR THE 2009 TONNAGE BONUS GRANT FOR THE ACUA

Freeholder Giordano moved and Freeholder Formica seconded a motion to accept a grant from the New Jersey Department of Environmental Protection consenting to have the President of the Atlantic County Utilities Authority accept from the Commissioner of Environmental Protection and Energy a 2009 Tonnage Bonus Grant.

RESOLUTION NO. 135
GRANT APPLICATION FOR MEGAN’S LAW ADMINISTRATION

Freeholder Cooper moved and Freeholder Giordano seconded a motion to submit a grant application to the New Jersey Division of Criminal Justice for Justice Assistance Grant funding for Megan’s Law Administration for an amount not to exceed $12,155.00, subject to a County cash match of $4,052.00.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

PUBLIC PORTION

Chairman Curcio opened the meeting to the public for their comments at 4:50 p.m. 

Russ Smith commented on the Pay to Play radio commentary and regarding the cost of copies for Open Public OPRA requests.

Creed Pogue (169 Cumberland Avenue, Estell Manor) spoke regarding the ACUA trash flow control.  He suggested putting the ordinance on hold to take time to explain the options for a lower cost.

Roy Trotta, President, of PBA Sheriff No. 233 asked if the furloughs would be mandated.

County Administration introduced Sheriff Captains who are sharing the responsibility as Acting Warden at the County Jail.

There were no further comments and Chairman Curcio closed the public portion at 5:18 p.m.

FREEHOLDER COMMENTS

Freeholder Formica spoke about Senior Citizens seeking jobs.  He suggested asking each casino to reserve ten spots for senior citizen hires.

Freeholder Cooper gave an update on the Animal Shelter proceeds from the recent fundraiser.  The animal shelter purchased six heaters that do not require electricity if a power outage occurs.  They also purchased a dozen nuzzle beds and raw hide treats for the dogs.

Freeholder Garrett attended his first Veterans Advisory Board Meeting.  He stated it was interesting and he looks forward to working with veterans.  The first issue to be addressed is homeless veterans.

WRITTEN CORRESPONDENCE

There was written correspondence received for the period of March 3, 2010 to March 9, 2010.

ADJOURNMENT

Chairman Curcio asked for a motion to adjourn the Freeholder meeting.  Freeholder Giordano moved and Freeholder Cooper seconded a motion to adjourn the Freeholder meeting.  The motion was unanimously passed.  The meet adjourned at 5:24 p.m.
