CALL TO ORDER |
A Regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman James Curcio at 4:18 p.m., Eastern Daylight Savings Time, on the above-mentioned date at the Auditorium, County Office Building, 1333 Atlantic Avenue, Atlantic City, New Jersey. |
OPEN PUBLIC MEETING STATEMENT |
Statement of Open Public Meeting Compliance: Pursuant to the Open Public Meetings Act, Chairman Curcio announced that adequate notice of this meeting, as required by said Act, has been provided to The Press, the Mainland Journal, posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk’s Office in Mays Landing. |
PRAYER AND FLAG SALUTE |
The prayer was led by Freeholder Giordano followed by the flag salute led by Chairman Curcio. |
NATIONAL ANTHEM |
The National Anthem was performed by Robyn Rosenthal. |

MINUTES OF MEETING
FEBRUARY 16, 2010 |
Freeholder Sutton moved and Freeholder Giordano seconded a motion to adopt and dispense with the reading of the February 16, 2010 minutes.

PROCLAMATIONS |
A proclamation was presented by Freeholder Giordano congratulating Robyn Rosenthal, Atlantic County Finalist for the Sixth Annual “NJ Shouts Down Drugs” Contest.
A proclamation was presented by Freeholder Cooper and Chairman Curcio proclaiming March 2010 as Women’s History Month. |
MOTION |
Freeholder Formica moved and Freeholder Schroeder seconded a motion to present the resolutions prior to Ordinance No. 7-2010.

RESOLUTION NO. 136
AGREEMENT FOR THE STOCKTON CENTER ON SUCCESSFUL AGING INITIATIVE |
Freeholder Giordano moved and Freeholder Cooper seconded a motion to enter into an agreement with Richard Stockton College of New Jersey to provide older adult educational programs and in-service training through the Stockton Center on Successful Aging Initiative for an amount not to exceed $20,000.00.

RESOLUTION NO. 137
RENEWAL BID CONTRACT FOR COMMISSARY SERVICES AND TRUST FUND ACCOUNTING AT THE ATLANTIC COUNTY JUSTICE FACILITY |
Freeholder Giordano moved and Freeholder Sutton seconded a motion to award a renewal bid contract to Keefe Commissary Network, LLC to provide commissary services and trust fund accounting at the Atlantic County Justice Facility for the commission rate of 39.7% (Revenue Generating).

RESOLUTION NO. 138
BID CONTRACT FOR HVAC MAINTENANCE AND REPAIR SERVICE |
Freeholder Sutton moved and Freeholder Formica seconded a motion to award a bid contract to Marlee Contractors, LLC to provide HVAC maintenance and repair service for an amount not to exceed $331,424.00.

RESOLUTION NO. 139
APPOINTMENT TO THE ATLANTIC COUNTY ADVISORY COMMISSION ON WOMEN |
Freeholder Cooper moved and Freeholder Schroeder seconded a motion to appoint Joyce A. Hagen to the Atlantic County Advisory Commission on Women for a term to expire on February 28, 2012.

IN SUPPORT OF SENATE BILL NO. 1123 AND ASSEMBLY BILL NO. 2424 |
Freeholder Sutton moved and Freeholder Giordano seconded a motion to pass a resolution in support of Senate Bill No. 1123 and Assembly Bill No. 2424 regarding Pinelands Commission Comprehensive Management Plan Revisions. (Co-sponsors: Chairman Curcio and Freeholder Sutton).

ORDINANCE NO. 7-2010

SOLID WASTE MANAGEMENT PLAN AMENDMENT FOR SOLID WASTE FLOW

Freeholder Giordano moved and Freeholder Sutton seconded a motion to adopt on Final Reading Ordinance No.7 of 2010 amending the Solid Waste Management Plan to authorize Solid Waste Flow Control.
Chairman Curcio opened the meeting to the public for their comments on Ordinance No. 7 of 2010 at 4:39 p.m.
Richard of Atlantic Cape Community College spoke in support of Ordinance No. 7-2010.
Patricia Ehrhardt spoke in support of Ordinance No. 7-2010. She also spoke in regards to JDJ Development investing in solar panels.
Claudia Radcliff spoke in support of Ordinance No. 7-2010. She also spoke about the Atlantic County Women’s Center.
Linwood Councilman Alex Marino spoke in support of Ordinance No. 7-2010 as long as the eastern region can lock in contracts for three years.
Patrick Gilroy, Union Representative from Dennis Township spoke regarding
Lou Walters is in support of Ordinance No. 7-2010. He stated that Atlantic County Sewerage Company is the ACUA’s largest customer.
Steve Burek of Barnegate is in support of Ordinance No. 7-2010.
Alan Schmidt of Galloway Township stated that they collected significant trash for the Adopt-A-Road Program.
Councilman Tim Carew of Northfield spoke in favor of Ordinance No. 7-2010.
Dale Goodreau of Egg Harbor Township spoke in support of Ordinance No. 7-2010.
There were no further comments and Chairman Curcio closed the public portion at 5:04 p.m.
Freeholder Joseph McDevitt, Chairman of the Solid Waste Oversight Committee spoke in support of Ordinance No. 7 of 2010.
Freeholder James Schroeder, member of the Solid Waste Oversight Committee spoke in favor of Ordinance No. 7 of 2010.
Freeholder Frank Sutton, member of the Solid Waste Oversight Committee spoke in favor of Ordinance No. 7 of 2010.
Freeholder Chairman James Curcio spoke in support of Ordinance No. 7 of 2010.
Freeholder Dase and Freeholder Cooper spoke in support of Ordinance No. 7 of 2010.
Chairman Curcio introduced into the record letters of support regarding the ACUA and the Solid Waste Ordinance from Community Food Bank of New Jersey, Dave’s Septic Service of Little Egg Harbor Township, Veolia Water Operating Services of Maple Shade, John Provenzano and Allen English from St. Augustine’s Prep School, Viking Yacht Company of New Gretna, Hamilton Township Municipal Utilities Authority, Bob’s Sanitation Services of Egg Harbor City, Margate Department of Public Works, Jeffrey Noone of Landisville, Mary Ann Iuliucci of Hammonton, Buena Borough Municipal Utilities Authority, McGowan Well Water Compliance Management, LLC of Ringwood, John F. Callaghan of Calmar Associates, Steve Nagiewicz of Atlantic City High School and Stephen R. Burak of NRG Energy, Inc. of Princeton.
Two letters were received that were opposed to the Ordinance from Kitchen Trends of Margate City and Corbin City.
Phone calls were received from Laureen Heath of Pleasantville, A.B. Maccarone of Egg Harbor City, Suzanne Sampson of Ventnor and Robert Lance of Ventnor opposing Ordinance No. 7 of 2010. |
AMENDING ORDINANCE NO.7

FIRST READING
SOLID WASTE AMENDMENT REGARDING WASTE FLOW |
Freeholder McDevitt moved and Freeholder Schroeder seconded a motion to approve Ordinance No. 7 as amended on first reading, amending the Atlantic County Solid Waste Management Plan to authorize Solid Waste Floe Control.
The amended Ordinance 7A was adopted by the following roll call: AYES: Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio. NAYS: None. ABSTENTIONS: None.

Freeholder Formica moved and Freeholder McDevitt seconded a motion to change the place of the April 20, 2010 Freeholder meeting from Northfield to Atlantic City.
