February 2, 2010

CALL TO ORDER

A Regular meeting of the Atlantic County Board of Chosen Freeholders was called to order by Chairman James Curcio at 4 p.m., Eastern Standard Time, on the above-mentioned date at the Stillwater Building, 201 Shore Road, Northfield, New Jersey.

OPEN PUBLIC MEETING STATEMENT

Statement of Open Public Meeting Compliance:  Pursuant to the Open Public Meetings Act, Chairman Curcio announced that adequate notice of this meeting, as required by said Act, has been provided to The Press, the Mainland Journal, posted on the bulletin boards at 1333 Atlantic Avenue, Atlantic City, the Stillwater Building, 201 Shore Road, Northfield and the County Clerk’s Office in Mays Landing.

PRAYER AND FLAG SALUTE

The prayer was led by Freeholder Garrett followed by the flag salute led by Chairman Curcio.

The following roll call was recorded:  PRESENT:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio. ABSENT:  None.

MINUTES OF MEETING
JANUARY 12, 2010

Freeholder Cooper moved and Freeholder Sutton seconded a motion to adopt and dispense with the reading of the January 12, 2010 minutes.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

PRESENTATION

Rhonda Lowery, Executive Director of the Atlantic Cape Workforce Investment Board gave a presentation regarding the services provided by the WIB.

ORDINANCE NO. 2-2010
FINAL READING
ESTABLISHING FEES FOR CERTAIN COUNTY SERVICES

Freeholder Sutton moved and Freeholder Cooper seconded a motion to pass on final reading Ordinance No. 2-2010, establishing fees for certain County services.

Chairman Curcio opened the meeting to the public for their input on Ordinance No. 2-2010 at 4:15 p.m.  Being none, Chairman Curcio closed the public portion at 4:15 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, Schroeder, Sutton and Curcio.  NAYS:  McDevitt.  ABSTENTIONS:  None.

ORDINANCE NO. 3-2010
FINAL READING
AMENDING THE CODE OF THE COUNTY OF ALANTIC, CHAPTER 86, LAND DEVELOPMENT STANDARDS

Freeholder Sutton moved and Freeholder Giordano seconded a motion to adopt on final reading Ordinance No. 3-2010 amending the code of the County of Atlantic, Chapter 86, Land Development and substituting portions thereof, entitled Atlantic County Land Development Standards.

Chairman Curcio opened the meeting to the public for their comments regarding Ordinance No. 3-2010 at 4:16 p.m.  Being none, Chairman Curcio closed the public portion at 4:16 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Formica, Garrett, Schroeder and Sutton.  NAYS:  Dase, Giordano, McDevitt and Curcio.  ABSTENTIONS:  None.

ORDINANCE NO. 4-2010
FINAL READING
AMENDING THE CODE OF THE COUNTY OF ATLANTIC REGARDING ROAD OPENING PERMITS/ HIGHWAY OCCUPANCY PERMITS, AND EXISTING FEE SCHEDULES  AND ESTABLISHING FEES FOR CERTAIN COUNTY SERVICES

Freeholder Sutton moved and Freeholder Cooper seconded a motion to adopt on final reading Ordinance No. 4-2010 amending the code of the County of Atlantic, Chapters 72 and 73, road opening permits/highway occupancy permits, and existing fee schedules and establishing fees for certain County services.

Chairman Curcio opened the meeting for public comment regarding Ordinance No. 4-2010 at 4:21 p.m.  Being none, Chairman Curcio closed the public portion at 4:21 p.m.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

RESOLUTION NO. 66
AGREEMENT FOR PROVISION OF COLLEGE INTERNS TO ATLANTIC COUNTY

Freeholder Sutton moved and Freeholder Giordano seconded a motion to enter into an agreement with Richard Stockton College of New Jersey for the provision of college interns to Atlantic County at no cost to the County.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

RESOLUTION NO. 67
AGREEMENT FOR THE PROVISION OF SUPPLEMENTAL HOME DELIVERED MEALS

Freeholder Cooper moved and Freeholder Sutton seconded a motion to enter into an agreement with Pur Foods, d/b/a Mom’s Meals for the provision of supplemental home delivered meals to eligible participants for an amount not to exceed $13,552.00.

The above-mentioned motion was adopted by the following roll call:  AYES:  Cooper, Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.

RESOLUTION NO. 68
BID CONTRACT FOR FURNISHING AND DELIVERING PLUMBING SUPPLIES

Freeholder Giordano moved and Freeholder Sutton seconded a motion to award a bid contract to Grant Supply Co., Inc. for furnishing and delivering plumbing supplies for an amount not to exceed $61,608.04.

The above-mentioned motion was adopted by the following roll call:  AYES:  Dase, Formica, Garrett, Giordano, McDevitt, Sutton and Curcio.  NAYS:  Schroeder.  ABSTENTIONS:  None.  ABSENT:  Cooper.

RESOLUTION NO. 69
BID CONTRACT FOR DISPLAY ADVERTISING

 

Freeholder Sutton moved and Freeholder Giordano seconded a motion to award a bid contract to South Jersey Publishing Company for display advertising for an amount not to exceed $100,400.00.

RESOLUTION NO. 70
CHANGE ORDER NO. 1 AUTHORIZING PURCHASES BY OTHER PUBLIC ENTITIES PURSUANT TO LFN 2009-20

Freeholder Sutton moved and Freeholder Garrett seconded a motion to award a change order to extend a contract with Global Connect for Emergency Community Notification services authorizing purchases by other public entities under the existing contract terms and conditions for the amount of the original contract of $130,000.00.

RESOLUTION NO. 71
LEASE AGREEMENT FOR RENTAL OF 80 PARKING SPACES AT 25 S. NORTH CAROLINA AVENUE, ATLANTIC CITY

Freeholder Sutton moved and Freeholder McDevitt seconded a motion to enter into a lease agreement with Resorts International Hotel, Inc. to lease 80 parking spaces from 6 a.m. to 6 p.m. Monday through Friday, at 25 S. North Carolina Avenue, Atlantic City for an amount not to exceed $90,000.00 per year (Three Year Contract).

RESOLUTION NO. 72
ACCEPTANCE OF DEEDS/EASEMENTS

Freeholder Giordano moved and Freeholder Sutton seconded a motion to accept deeds/easements from various grantors in accordance with Atlantic County Planning Standards.

RESOLUTION NO. 73
AGREEMENT FOR OPERATION OF THE OPPORTUNITY RECONNECT CENTER

Freeholder Giordano moved and Freeholder Schroeder seconded a motion to enter into an agreement with Career Opportunity Development, Inc. for co-locating staff in the County Office Building, 1333 Atlantic Avenue, Atlantic City, to provide services to ex-offenders for a two year period at no cost to the County.

RESOLUTION NO. 74
LEASE AGREEMENT FOR 150 PARKING SPACES AT THE NEW YORK AVENUE GARAGE IN ATLANTIC CITY

Freeholder Sutton moved and Freeholder Schroeder seconded a motion to enter into a lease agreement with the South Jersey Transportation Authority to lease 150 parking spaces at the New York Avenue Garage in Atlantic City for an amount not to exceed $117,000.00 per year (Three Year Contract).

RESOLUTION NO. 75
APPOINTMENT TO THE ATLANTIC COUNTY AGRICULTURE DEVELOPMENT BOARD

Freeholder Giordano moved and Freeholder Schroeder seconded a motion to appoint Frank Schoenstein to the Atlantic County Agriculture Development Board for a term to expire on December 1, 2014.

The above-mentioned motion was adopted by the following roll call:  AYES:  Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.  ABSENT:  Cooper. 

RESOLUTION NO. 76
SUPPORTING EFFORTS TO PROVIDE RELIEF TO HAITI

Freeholder Sutton moved and Freeholder Giordano seconded a motion to pass a resolution in support of efforts to provide relief to Haiti (Sponsor:  Freeholder Garrett).

The above-mentioned motion was adopted by the following roll call:  AYES:  Dase, Formica, Garrett, Giordano, McDevitt, Schroeder, Sutton and Curcio.  NAYS:  None.  ABSTENTIONS:  None.  ABSENT:  Cooper.

PUBLIC PORTION

Chairman Curcio opened the meeting to the public at 5:09 p.m.

Bill Doughty of 17 Habiv Drive, Northfield, NJ spoke regarding the installation of tenax fencing to prevent turtle road kill and improve driver safety (See attached).

There were no further comments.  Chairman Curcio closed the public portion at 5:26 p.m.

FREEHOLDER COMMENTS

Freeholder Formica requested a response from the State regarding Atlantic City’s audit.

Freeholder Giordano attended the graduation for the Atlantic County Correction Officers and stated it was a great event.

Freeholder Schroeder spoke regarding the New Jersey Association of Counties.

Chairman Curcio received a resolution from Mullica Township and Cape May County urging the Freeholders to move forward in reestablishing the train schedule.

WRITTEN CORRESPONENCE

Written Correspondence was received by this office from January 27, 2010 to February 2, 2010.

ADJOURNMENT

Chairman Curcio asked for a motion to adjourn the Freeholder meeting.  Freeholder Giordano moved and Freeholder Garrett seconded a motion to adjourn the Freeholder meeting.  The motion was unanimously passed.  The meeting was adjourned at 5:35 p.m.
